Is it Illegal to re sell Free bottled water handed out by Emergency Services?

I heard about a Chap who was touring round Gloucester loading his 4WD with bottled water and flogging it at �1 a bottle, then when people complained his brother took the rest to his corner shop in Birmingham where he sells it, Imoral yes but Illegal?
